Can I stop my Texas foreclosure by suing my mortgage company for robo-signing or filing fraudulent documents?

Apparently not.

On Feb. 20, 2014, the 5th Circuit Court of Appeals affirmed the dismissal of a lawsuit brought against Wells Fargo Bank, N.A. in Texas for, among other things, having a "robo-signed" assignment. Golden v. Wells Fargo Bank, 5th Circuit Court of Appeals, 2014. The 5th Circuit is the highest federal appeals court in the states of Louisiana, Mississippi and Texas.

If you are trying to stop a foreclosure in Texas, you may want to consider either asking your mortgage company for a loan modification, or filing a chapter 13 bankruptcy to cure the delinquent mortgage payments.
